Major Reform in Alimony System: Is Lifetime Alimony Coming to an End?

A new reform is underway for the alimony system, one of the most debated issues in divorce cases. The ruling AK Party, in collaboration with the Ministry of Justice and the Ministry of Family and Social Policies, aims to redefine the duration and conditions of alimony payments. The plan includes ending lifetime alimony except in specific circumstances.

Family Law Review Board Takes Action

The Ministry of Justice has established the Family Law Review Board to address shortcomings in the alimony system and ensure a fair resolution. The board is reviewing international practices to reform divorce proceedings and eliminate uncertainties surrounding alimony.

Divorce and Alimony Cases to Be Separated

Currently, divorce cases are handled alongside issues such as alimony, asset division, and child custody. However, under the proposed reforms, alimony and asset division cases will be processed separately to shorten divorce proceedings.

Additionally, new legal measures aim to prevent prolonged divorce cases from negatively impacting women and children. Updates to family court procedures and the introduction of mediation for non-violent family disputes are also being considered.

New Criteria for Lifetime Alimony

Lifetime alimony is among the most controversial aspects of the current system. The proposed changes aim to end indefinite alimony, except in specific cases.

According to Türkiye Gazetesi, the following criteria will be used to determine the duration of alimony:

  • Length of the marriage
  • Age of the spouse receiving alimony
  • Financial status
  • Whether there are children
  • Degree of fault in the divorce

However, in cases where the recipient is unable to work due to health or other valid reasons, lifetime alimony payments may still continue.

The reforms are expected to be included in the upcoming judicial package and brought to the Parliament’s agenda soon.
